Phoenix Seminary is committed to safeguarding the privacy of personal data. This Privacy Notice outlines the collection, use, and disclosure of personal information provided to the Seminary by students, faculty and staff, alumni and other members of our community. Seminary Use of Information

Phoenix Seminary collects and processes personal data ("Information") from individuals only as necessary in the exercise of the Seminary's legitimate interests, functions and responsibilities as a private, non-profit institution of higher education. For example, Phoenix Seminary also collects and processes Information from individuals who are applicants for employment positions. Information collected from students or student applicants is used to register or enroll persons in the Seminary, manage a student account, provide academic advising, develop and deliver education programs, track academic progress, analyze and improve education programs, recruitment, regulatory reporting, auditing, maintenance of accreditation, and other related Seminary processes and functions. Phoenix Seminary also uses Information to conduct general demographic and statistical research to improve Seminary programs, to identify appropriate support services or activities, provide reasonable accommodations, enforce Seminary policies or comply with applicable laws. Finally, Information may be shared by Phoenix Seminary with third parties who have entered into contracts with the Seminary to perform functions on behalf of the Seminary, subject to the obligation of confidentiality and safeguarding from unauthorized disclosure.

Third Party Use of Sensitive Information

We may disclose your Sensitive Information and other Information as follows:

• Consent: We may disclose Information if we have your consent to do so.
• Emergency Circumstances: We may share your Information when necessary to protect your interests and you are physically or legally incapable of providing consent.
• Employment Necessity: We may share your Information when necessary for administering employment or social security benefits in accordance with applicable law or any applicable collective bargaining agreement, subject to the imposition of appropriate safeguards to prevent further unauthorized disclosure.
• Public Information: We may share your Information if you have manifestly made it public.
• Archiving: We may share your Information for archival purposes in the public interest, and for historical research and statistical purposes.
• Performance of a Contract: We may share your Information when necessary to administer a contract you have with the Seminary.
• Legal Obligation: We may share your Information when the disclosure is required or permitted by international, federal, and state laws and regulations.
• Service Providers: We use third parties who have entered into a contract with the Seminary to support the administration of Seminary operations and policies. In such cases, we share your Information with such third parties subject to the imposition of appropriate safeguards to prevent further unauthorized disclosure.
• Seminary-Affiliated Programs: We may share your Information with parties that are affiliated with the Seminary for the purpose of contacting you about goods, services, charitable giving or experiences that may be of interest to you.
• De-Identified and Aggregate Information: We may use and disclose Information in de-identified or aggregate form without limitation.

Retention and Destruction of Your Information

Your information will be retained by the Seminary in accordance with applicable state and federal laws, and the applicable retention periods in the Seminary's Records Management policy. Your information will be destroyed upon your request unless applicable law requires destruction after the expiration of an applicable retention period. The manner of destruction shall be appropriate to preserve and ensure the confidentiality of your information given the level of sensitivity, value and criticality to the Seminary.

Your Rights

You have the right to request access to, a copy of, rectification, restriction in the use of, or erasure of your information in accordance with all applicable laws. The erasure of your information shall be subject to applicable state and federal laws, and the applicable retention periods in the Seminary's Records Management policy. If you have provided consent to the use of your information, you have the right to withdraw consent without affecting the lawfulness of the Seminary's use of the information prior to receipt of your request.

Information created in the European Union will be transferred out of the European Union to the Seminary. If you feel the Seminary has not complied with applicable foreign laws regulating such information, you have the right to file a complaint with the appropriate supervisory authority in the European Union.

Updates to This Policy

We may update or change this policy at any time. Your continued use of the Seminary's website and third party applications after any such change indicates your acceptance of these changes.

Seminary (“Phoenix Seminary” or “the Seminary”) provides this website [https://ps.edu] and the application portal (“sites”) as a service to students, faculty, alumni, and prospective students.  Use of the sites is subject to the terms and conditions set forth below in Phoenix Seminary’s Privacy Policy (“policy”).

Although Phoenix Seminary respects the privacy of this site’s users (or “members” or “visitors”), the Seminary collects information from its website members and visitors.  The Privacy Policy governs users’ interaction with the site and users’ registration for and use of the site’s online services.  Except as set forth within this Privacy Policy and/or other published guidelines, Phoenix Seminary does not release personally identifiable information about the site’s visitors without their permission.

The Information Phoenix Seminary Gathers

Phoenix Seminary gathers two types of information about the site’s users:

1. Non-personally identifiable information.  As users access the site, Phoenix Seminary collects and aggregates information indicating, among other things, which pages were visited, the order in which they were visited, and which hyperlinks were employed.  Collecting such information involves the logging of IP addresses, operating system, and browser software used by each visitor.  Although such information is not personally identifiable, the Seminary can determine from the IP address a visitor’s Internet Service Provider and the geographic location of the user’s point of connectivity.

   The non-personally identifiable information collected helps in diagnosing any server problems, administering the site, identifying the most popular areas of the site, and determining the effectiveness of promotional activities.

   For the same purposes, the Seminary uses “cookies” – that is, small text files placed on your computer’s hard drive – to help determine the type of content and sites visited, the length of time spent on a particular site, and the usage of services offered via the site.  For information on how users can control their Web browser’s acceptance of cookies, please refer to the documentation accompanying the browser.

2. Personally identifiable information.  Certain areas of the site may require that users provide personally identifiable information (including, for example, zip code, age, income, and e-mail address).  In addition, when registering to set up an account to use certain services on the site such as e-mail, chat rooms, forums, or to receive newsletters or specifically targeted information (“services”), Phoenix Seminary may require that users provide their name and e-mail address.

   The Seminary does not knowingly collect personally identifiable information from children (defined herein as minors younger than thirteen years of age) without obtaining parental consent.  Before registering for an account to use the services of the site, Phoenix Seminary requests that all minors have their parents read the Privacy Policy and continue their involvement throughout the registration process.

   Phoenix Seminary does not control the acts of this site’s members or visitors.  All members and visitors should be aware that their disclosure of personally identifiable information in a bulletin board, chat room, guest book, or other forum allows other parties to send them unsolicited e-mail.  In the event visitors encounter any user on this site who is improperly collecting or using information provided by the site’s members or visitors, please contact webcomm@ps.edu.

How the Seminary Uses/Does Not Use Gathered Information

Please take some time to become familiar with the different ways Phoenix Seminary uses the information gathered.  Keep in mind that, while the Seminary encourages all third parties involved to adhere to this site’s Privacy Policy and to otherwise handle personal information in a responsible manner, Phoenix Seminary cannot and does not assume any responsibility for any actions or omissions of third parties, including the manner in which they use information received either from the Seminary or independently.  Nevertheless, in the event users encounter any third party associated with, or who claims association with Phoenix Seminary, who is improperly collecting or using personal information, please contact webcomm@ps.edu who will forward the message to the third party.

1. Use of non-personally identifiable information.  The Seminary uses non-personally identifiable information in aggregate form to build higher quality, more useful online services by performing statistical analyses of the collective characteristics and behavior of the site visitors, and by measuring demographics and interests regarding specific areas of the site.

   The site may contain links to other Internet Web site, including co-branded or other affiliated sites that may or may not be owned or operated by Phoenix Seminary.  Unless otherwise explicitly stated, the Seminary is not responsible for the privacy practices or the content of such sites, including such sites’ use of any information (such as IP number, browser type, or operating system) collected when visitors to the site click through links to those sites.  Even though such information might not identify the user personally, users should be familiar with the privacy practices of those other sites.

2. Use of personally identifiable information.  The Seminary provides notice to potential registrants of this site whose personally identifiable information will be collected during the registration process.  Such notice is provided simultaneously with the user’s registration on this site; moreover, this policy itself serves as notice that such information is collected under those circumstances.  Although users may not “opt out” of the registration process and still receive access to the services, users may choose to “opt out” of receiving promotional materials from the Seminary and/or other business partners.  If the user does not “opt out” of receiving such promotional materials, Phoenix Seminary reserves the right to release user’s personally identifiable registration information to third parties who provide goods or services that the Seminary believes may be of interest to the user.  If the user decides to discontinue receiving promotional information from such third parties, please contact those third parties directly, or contact Phoenix Seminary atwebcomm@ps.edu.

   Phoenix Seminary limits its own e-mail contact and solicitations to those users who have not “opted out” of receiving such communications.  The solicitations are limited in that they, among other things, will clearly indicate the originator of the e-mail and provide the user with a method of “opting out” of receiving future communications of a similar nature.

   Finally, Phoenix Seminary may use individual members’ data to “pre-populate” forms, which are displayed for the purpose of collecting individual data by the Seminary.  In no case does pre-populating a form transfer any data to any third party.  Only if the user voluntarily requests that such data be transferred will any transfer take place – for example, if/when a user clicks a “submit form” button or other button.

   Phoenix Seminary reserves the right to release any and all information contained within access logs concerning any visitor when that visitor is in violation of the Seminary’s published guidelines, or partakes (or is reasonably suspected of partaking) in any illegal activity, even without a subpoena, warrant, or other court order, and to release such information in response to discovery requests, or in response to any circumstance in which the Seminary, in its sole discretion, deems an emergency.  Phoenix Seminary cooperates with law enforcement agencies in identifying those who may be using its servers or services for illegal activities.  Phoenix Seminary also reserves the right to report any suspected illegal activity to law enforcement for investigation or prosecution.

   Phoenix Seminary will post the relevant privacy information in the official rules and/or registration area for any promotions it sponsors.  That privacy information, to the extent it conflicts with this Privacy Policy, will govern that particular promotion.

Security

All information gathered on the site is stored within a controlled database accessible only to the Seminary to protect the loss, misuse, or alteration of the information under its control.  However, as effective as any security measure implemented by the Seminary may be, no security system is impenetrable.  Phoenix Seminary cannot guarantee the security of its database, nor can it guarantee that the information supplied by users will not be intercepted while being transmitted over the Internet.  Questions regarding this Privacy Policy should be directed to webcomm@ps.edu.

This agreement is entered into in the state of California and shall be governed by and construed in accordance with the laws of the state of California, exclusive of its choice of law rules.  Each party to this agreement hereby submits to the exclusive jurisdiction of the state and federal courts in the state of California, and waives any jurisdictional, venue, or inconvenient forum objections to such courts.  In any action to enforce this agreement, the prevailing party will be entitled to costs and attorneys' fees.  In the event that any of the provisions of this agreement shall be held by a court or other tribunal or competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that this agreement shall otherwise remain in full force and effect and enforceable.

This agreement constitutes the entire agreement between the parties hereto pertaining to the subject matter herein, and any and all prior or contemporaneous written or oral agreements existing between the parties hereto are expressly canceled.  No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.  Any heading, caption, or paragraph title contained in this agreement is inserted only as a matter of convenience and in no way defines or explains any paragraph or provision herein.

Phoenix may at any time change the site, including eliminating or discontinuing any content or feature of the site, restricting its availability or limiting the amount of use permitted.  Such changes, modifications, additions, or deletions shall be effective immediately upon notice thereof, which may be given by any means including, but not limited to, posting on the site, or by electronic mail, or by conventional mail.  Use of the site after such notice shall be deemed to constitute user's acceptance of such changes, modifications, additions, or deletions.

By proceeding with registration, you are consenting to conduct transactions and enter into agreements electronically, with no paper confirmation of said transactions/agreements to be provided. These transactions/agreements may occur at any time during your academic career and may include but are not limited to any of the below stated items. Phoenix Seminary may provide communications and engage in transactions with you in paper form at any time, despite this consent. This includes receiving all communications via the institution’s primary method of contact, which includes but is not limited to personal email account, via the student portal, PS.com or by phone/text to any active phone number provided by me in my student record. Communications may include the following:

• Student Accounts documents that may include but are not limited to billing statements, statement changes, payment plan changes, payment due notifications, late payment notices, account holds, collections, legislative notice requirements, and tax document availability.
• Registration Documents that include but are not limited to FERPA Release Requests, Graduation Applications, ordering Official Transcripts, release of information to third parties, and Student Verification Request Forms.
• Admission Documents that include but are not limited to Applications for Admission, Admissions Offer Acceptance.
• Financial Aid Documents that include but are not limited to Accepting/Declining Financial Aid Awards, Release, or Return Funds including Title IV funds.
• Miscellaneous Documents that include but are not limited to receipt of consumer information about the Seminary that may be required by law or regulation such as any disclosure, consent, waiver, release, or notice.
• This consent also includes consent to receive your 1098T statement electronically in the student portal, where it will be available annually from January 31 for a minimum of three years from issuance. If you want to retain a paper copy of any record provided electronically you should print a copy from your student portal account. Any post-consent request for the statement in paper form will be considered a withdrawal of consent.

I specifically consent to receive my year-end 1098T tax form electronically via my student portal unless I have taken the appropriate measures to opt-out of electronic delivery, in which case a paper copy will be made available. To opt out and request a paper copy, I must email a notice to: finance@ps.edu

Written notice must include your specific request to opt-out of the electronic delivery option for your 1098T document and verification of your current address on file with the institution. If your address is incorrect, you must update your address information via student your portal prior to submitting this request. My request must be received by Phoenix Seminary no later than October 31st of the tax year for which I wish to elect paper delivery. If I do not fulfill the opt-out requirements by the stated deadline, I will be able to view and print a copy of my 1098T by accessing my student portal. Although the duration of this agreement is indefinite, I may withdraw my consent by following the instructions above. Confirmation of my consent withdrawal will be sent to my personal email address.
